This presentation will be on the passage and development of the Insurance Placement Liability Act (734 ILCS 5/2-2201). Since its passage and enactment, Illinois appellate courts have applied the Act in various ways, specifying who can be sued pursuant to the Act and what actions do (and do not) trigger duties under the Act. These cases culminated in the Illinois Supreme Court’s decision in Skaperdas v. Country Casualty Insurance Company, which gave significant guidance concerning the contours of the Act. This presentation will focus on the Insurance Placement Liability Act, the language of the Act and its elimination of certain causes of action against Illinois insurance producers, and the manner in which courts have interpreted the Act, centering on the identity of individuals captured by the Act and the duties imposed on “insurance producers” under the Act.
